Appellant was indicted for the crime of murder. He was . tried, found guilty as charged, and sentenced to death. He appeals from the verdict and sentence. There are three bills of exception in the record.
Bill of exception No. 2 was reserved to the action of the trial judge in overruling defendant’s objection to the admission of the testimony of one Alex. Mizell, apparently a deputy sheriff, introduced by the state to prove a confession made by the accused.
