MEMORANDUM OPINION AND ORDER

Before the Court are the 12(b)(6) Motions to Dismiss of Defendants Hilco Re ceivables, L.L.C. and Central Credit Services, Inc. [Docket Entries # 33 and # 34], For the reasons stated below, Defendants’ Motions are DENIED IN PART and GRANTED IN PART.
