This proceeding comes before us upon a motion presented by respondents for permission to present to the trial court a motion for a new trial.

The pertinent part of the motion states:

“Come now the respondents, James R. Chadwick and Esther James Chadwick, his wife, and Martha Y. Benoit, as Executrix of the Estate of Raoul S.
