This case comes before the court on the motions of defendant Donald DeMoulin (“DeMoulin”) for summary judgment (Doc. 333) and to strike plaintiffs expert witness (Doc. 336). Plaintiff Kindergartners Count, Inc. (“KCI”) has asserted claims of copyright infringement, 17 U.S.C. § 101 et seq., and unfair competition under the Lanham Act, 15 U.S.C. § 1116.
