This is a common-law action for damages for injuries sustained by. the plaintiff-respondent through the alleged negligence of the servants of defendants-appellants. He recovered a judgment slightly in excess of $7500. The defense made was that, all the parties involved were under the Workmen’s Compensation Act,, and that the respondent’s remedy thereunder was exclusive. The several appellants jointly were the general contractors for the erection of the Municipal Auditorium built by Kansas City. The respondent was an employee of a subcontractor.
