McMILLIAN, Circuit Judge.
Vernon S. Krimmel appeals from a final judgment entered in the District Court 1 for the District of Nebraska, denying Krimmel’s 28 U.S.C. § 2254 petition for a writ of habeas corpus. We originally filed an opinion in this case on January 13,1995. However, because of a concern with the disposition, we vacated that opinion and sua sponte ordered a rehearing by the panel. For the reasons discussed below, we affirm.
