Plaintiff, a mutual water company, brought this action to quiet its title as against defendant, a public utility, to three cubic feet of water per second, diverted from the Kaweah River, and to quiet its title to a one-third interest in the Foothill Ditch by which the water is diverted from the river to the Wallace ranch. Only that portion of the ditch from the point of diversion in the river to plaintiff’s place of use is involved in this action, plaintiff claiming no interest in the ditch beyond the Wallace ranch.
