This matter is before the Court on defendant’s Motion for Summary Judgment. Defendant seeks summary judgment on the basis that plaintiff has failed to comply with the statute of limitations, as set forth in the insurance policy which defendant issued to plaintiff.

Plaintiff formerly operated an automobile repair business in San Leandro, California, which was known as the Foreign Stables Garage. Plaintiff purchased a special multi-peril insurance policy from defendant to insure his business operation. The policy was purchased through Schmidt and Schmidt,…
