An indictment was returned by the Clark County Grand Jury charging appellants with selling marijuana in violation of NRS 453.030 and 453.210(2). In this appeal from the denial of a pre-trial writ of habeas corpus they challenge (1) the sufficiency of the evidence to establish probable cause, (2) the constitutionality of the statute and (3) contend the statute under which they are charged was repealed by Stats, of Nev. 1971, ch. 667.
