Arthur C. J ohnson sued Marie F. J ohnson for specific performance of a.contract for the sale of corporate stock. Judgment went against him; hence this writ of error.

On August 13,1919, the plaintiff and his brother, Fred P. Johnson, owned all of the capital stock (3,000 shares) of the Record Stockman Publishing Company, the former owning 1,501 shares, and the latter 1,499.
