LyNCH, Judge:

By this proceeding, the Gauley & Summersville Railroad Company seeks to condemn a right of way 66 feet wide and 305 feet in length through six acres of land jointly owned by BE. G. Yencill and R. L. Neil. By charter it is authorized to construct and operate a railroad from the mouth of Peters creek, a tributary of Gauley river, to the town of Summers-ville, the county seat -of Nicholas county, a distance of 18 mjles. The circuit court, having found for the applicant on all the issues joined, permitted the condemnor to enter upon and hold the way in fee, upon payment of the sum…
