The action is brought to recover damages for personal injuries. On September 6, 1924, the plaintiff, an employee of the city of Menasha as a motorcycle police officer, sustained personal injuries in said city while in the discharge of his duties, in a collision with the automobile owned by the defendant Frank Kutcher, operated at the time by his wife, the defendant Emma Kutcher. Both the *21plaintiff and the city were at the time of the accident subject to the provisions of the workmen’s compensation act.
