In this case, the plaintiff, Greater Boston Real Estate Board, challenges the validity of an ordinance adding § 10A to c. 34 of the Ordinances of 1984 of the City of Boston. Section 10A provides that a permit must be obtained from the rent equity board (board) before certain rental housing units can be converted to condominiums or cooperative housing. We conclude that § 10A is invalid because the city was not expressly or impliedly authorized by the Legislature to enact it.
