In 2003, a Superior Court judge (motion judge) declared invalid the second sentence of § 2.46.030(A) of the Revised Ordinances (ordinance) of the city of Springfield (city), which exempted from the authority of the Springfield Historical Commission (commission) “any buildings, structures or properties however owned or controlled by the Springfield Library and Museum Association [(association)] and Roman Catholic Bishop of the Diocese of Springfield [(diocese)].” The motion judge determined that the exemption, based on the identity of a property owner, was not authorized by the Historic…
