—Proceeding pursuant to Executive Law § 298 to review a determination of the respondent Commissioner of the New York State Division of Human Rights dated August 17, 1990, which, after a hearing, found that the petitioner had discriminated against the complainant and awarded him the sum of $25,000 as compensatory damages for mental anguish and humiliation.

Adjudged that the petition is granted, on the law, the determination is annulled, and the complaint is dismissed, with costs to North Shore University Hospital, payable by the Commissioner of the New York State Division of Human Rights, to be…
