charged the jury as follows:

Gentlemen:—The stenographer in this case was selected to take the official records of the proceedings before a referee, and, of course, is entitled to a proper compensation for so doing.

There is evidence before you that some conversation Avas had between the counsel for the respective parties and the stenographer, in the presence of the referee, in regard to the manner in which he should be compensated. One of the counsel suggested that each side should pay half, and the other side suggested that the successful party should pay the Avhole amount and…
