On the 9th day of August, 1907, the plaintiff in error as plaintiff below sued the defendant in error as defendant below in the Circuit Court of Marion County, the declaration alleging as follows:

“For that whereas heretofore to-wit: On the 17th day of December, A. D., 1903, the Railroad Commissioners duly existing and organized under the laws of the State of Florida, at a meeting of the said Commissioners held in Tallahassee, Florida, of which the defendant had due. notice and appeared before the said Commissioners at said meeting, made and passed an order in part as follows, to-wit : ‘The…
