The plaintiff in the first case, a minor, hereinafter referred to as the plaintiff, seeks to recover damages for personal injuries sustained at about two o’clock in the morning of October 31, 1937, when she was a passenger in a taxicab which was in collision with a truck' owned and operated by the defendant, at the intersection of Chickering Road and Main Street, public ways in North Andover. The plaintiff in the second case is her father and seeks to *585recover for his consequential damages.
