The appellant, Charlie Dunn, was indicted in the Lincoln circuit court for carnally knowing Irene Hamner, a female above the age of twelve years and under the age of sixteen years, against her will or consent and by force, and upon the trial he was convicted and his punishment fixed nt ten years’ confinement in the penitetiary.
