Appeal from a judgment of the County Court of Albany County (Rosen, J.), rendered September 17, 1997, upon a verdict convicting defendant of the crime of manslaughter in the first degree.

On September 7, 1996, defendant’s brother and roommate, James Layman, was found dead on the floor of his bedroom. Initially, police authorities were led to believe that the victim had been involved in a fight with several neighborhood youths.
