MEMORANDUM OPINION

ACKER, District Judge.

Defendants, International Union of Operating Engineers, AFL-CIO and its Local 660 renewed their motions for summary judgment after the mandate of the Eleventh Circuit was issued on October 26, 1989, and after this court’s opinion of June 27, 1990, 742 F.Supp. 1517, which denied the motion of plaintiff, Edward C. Hester, for leave to amend his complaint to add a Fifth Claim. These motions again challenge Hester’s First Claim, Second Claim, Third Claim and Fourth Claim.
