Appeal from Hardin District Court. — Hon. D. E. Hindman, Judge. Action to recover damages alleged to have been caused by negligence on the part of the defendant, which resulted in the death of J. J. McDermott, the plaintiff’s intestate. There was a trial by jury, and a verdict and judgment in favor of the plaintiff. The defendant appeals.

On the fifteenth day of January, 1888, J. J. McDermott was, in the employment of the defendant as brakeman on a freight train. In the morning of that day his train was in part made up in the yard at Ft. Dodge, and contained eight empty coal ears, a loaded box car and a caboose; the caboose being at the rear end of the train and the box car next to it. The coal cars appeared to have been coupled together; and McDermott coupled the front one of these to the tender, and the rear end to the box car.
