delivered the opinion of the court:
This case comes before the court on defendant’s exceptions to the recommended decision of Trial Judge Fletcher, filed September 27,1979, pursuant to Rule 134(h). We must decide whether the trial judge was correct in concluding the federal government must contribute 90 percent of the actual settlement costs of two lawsuits arising from highway construction. After considering the written submissions of the parties and their oral presentations, we reject the trial judge’s report and require 90 percent federal participation only to the extent…
