This is an appeal from a jury verdict finding the defendant, Mark W. Donovan, guilty of tampering with a witness in violation of RSA 641:5.

The tampering charge arose from events which occurred while the defendant was awaiting trial on an assault charge filed in October 1978 by one Jack Vincent. On November 16, 1978, the defendant, his brother, and an acquaintance known at different times as “Wilfred”, “Looney Tunes,” or “Rock ’n Roll” Lamontagne confronted Vincent at Anthony’s House of Pizza.
