This case is before us on appeal from a judgment entered upon a directed verdict in favor of the plaintiff, and from the order denying a new trial. The action was instituted by the plaintiff to recover of ¡the defendant treble the value of the use and occupation of a certain 'quarter section of land situated in Spink county.
