SCHALLER, J.
The respondent, the Commissioner of Correction, appeals from the judgment of the habeas court granting the third amended petition for a writ of habeas corpus filed by the petitioner, Rafael Crespo. On appeal, the respondent claims that the habeas court, in concluding that the petitioner was deprived of his right to the effective assistance of counsel, improperly determined that his trial counsel’s deficient performance was prejudicial. We agree with the respondent and, accordingly, reverse the judgment of the habeas court.
