HARPER, Judge.

—Appellant was prosecuted for murder and convicted of murder in the second degree, his punishment being assessed at ten years confinement in the penitentiary.

It appears that deceased and Miss He!an McMillan, who afterwards became the wife of appellant, had known each other from childhood, residing in Delta County. It' would further appear that they at one time were engaged to be married. Deceased left Delta County and went to Oklahoma.
