HAWKINS, Judge.

Conviction is for the murder of Robert Garner, with punishment assessed at confinement in the penitentiary for twenty-five years.

The killing occurred in Belton on November 25, 1922, on a Saturday afternoon when many people from surrounding trade territory were in the city. Deceased and appellant lived in the same community and had known each other for years. No ill feeling appears to have existed between them until a few months prior to the homicide.
