This cause comes before the Court pursuant to Gibson’s Dispositive Motion for Partial Summary Judgment as to Count I of the Complaint (Doc. # 5), filed on April 25, 2007. XL Specialty Insurance Company and XL Reinsurance America, Inc., (collectively referred to herein as “XL”) jointly filed a response on May 9, 2007. (Doc. # 8). On July 31, 2007, though, Gibson filed an amended complaint dropping two counts. (Doc. #20.) Gibson’s only remaining count is a claim for payment under a surety bond issued by XL. (Doc. # 20.)
