This action was commenced iby Hattie Roberson, as plaintiff, against Seal Oil Company and R. M. Parish, as defendants, birt it appears that R. M. Parish transacted business under the trade name of Seal Oil Company, and hence he is the so’e party defendant. In this opinion we will allude to the parties as they appeared in the lower court.
