Defendant appeals from a judgment entered after a nonjury trial awarding plaintiff Ferdinando Daluiso, now deceased, damages for personal injuries sustained as a result of defendant’s forcible entry onto certain land on wbieh plaintiff resided. The incident arose out of a dispute over a boundary line and defendant’s removal of a fence which he claimed was actually located on his property. The principal question raised before us is whether the trial court erred in failing to determine whether or not defendant had title to that portion of the land on which the fence was located.
