DUNCAN, Judge.

OPINION

This case was previously before this Court on the defendant’s direct appeal of his conviction for armed robbery, for which offense he received a penitentiary sentence of twenty years. In an opinion dated March 8, 1974, the defendant’s conviction was affirmed by this Court. Subsequently, the Supreme Court granted certiorari, vacated the defendant’s conviction, and remanded the cause to the Criminal Court of Hamilton County for further proceedings. McKeldin v.
