This was a proceeding on the part of the county of Dougherty to condemn certain lands of the defendant for the purpose of erecting a free bridge over Flint River near Albany. It was shown that Tift had in operation a toll-bridge near by, and that the erection of a free bridge would entirely destroy the value of Tift’s fridge. Various estimates were submitted to the jury as to the value of Tift’s bridge. The jury returned a verdict assessing Tift’s damages at ten thousand eight hundred dollars.
