J. B. Knox, appellant, plaintiff below, sued the Farmers’ State Bank of Merkel, defendant below, for the sum of $1,-500 damages alleged to have been occasioned him by the failure and refusal of said bank to release a deed of trust on his lands, thus enabling him to sell an oil and gas lease on the property for that amount. The plaintiff alleged the indebtedness secured by the deed of trust had been fully paid, and that he informed the defendant that a lease upon the-land could be sold for such sum, provided the defendant would release the apparent lien upon the plaintiff’s land.…
