The learned counsel for the appellant insists that the circuit court erred in finding that the appellant, Schmitt, was a partner in the firm of II. Biedeburg & Co., and that it was error to charge him personally with any part of the losses of said firm; and he also insists that the court erred in holding that the distillery property should be charged with the payment of any part of the debts of said firm.
