—The surviving trustee comes into court and presents his account .for the purpose of distributing the corpus of the trust estate left by testator under the provisions of the sixth paragraph of his will for the benefit of his brother, John J. Jones, now deceased.

David Jones, the testator, died at ¡New Rochelle, in this county, on January 17, 1881, unmarried and without issue. There survived him as only next of kin a brother and four *584sisters, namely, John J. Jones, Mary J. Griffith, Susan J. Dannat, Jane J. Thayer and Margaret A. Jones.

John J. Jones was married but childless.…
