This action was commenced in the district court of Juab county by the plaintiff, as receiver of the Merchants’ Bank of *132Salt Lake City-j against the defendant as a stockholder of said bank, to recover from N him the additional liability which is imposed under the provision of the Constitution of this state, to which reference will hereinafter be made.
