This is a suit by appellee against the appellants for damages on account of personal injuries growing out of a collision of an automobile in which the appellee was an occupant and a freight train operated by appellants at a point where the railroad tracks intersected Calumet avenue in the city of Hammond. The complaint was in two paragraphs; the first paragraph charging the violation of three ordinances of the said city. The ordinances charged to be violated were:

1. The failure to maintain safety gates at said intersection.

2. An ordinance restricting the speed of trains to twenty-five…
