Before the Court is Defendants’ Motion to Dismiss the Plaintiffs survival and wrongful death case which was originally filed in the Court of Common Pleas of Westmoreland County, Pennsylvania, but was removed by Defendants who claimed diversity jurisdiction pursuant to 28 U.S.C. § 1332(a)(1). See doc nos. 1 and 6.
