Appellant is a carpenter, and as such was employed by appellee to work with other carpenters to remodel a dwelling house' then owned by appellee and used by him as a residence. On the first day of such employment, while assisting in lowering the roof, appellant received an accidental injury which arose out of and in the course of his employment. His application for compensation was denied. At the time of such injury and for twenty years prior thereto, appellee owned and operated a restaurant and confectionery business, and had no other business, trade or profession.
