LIVINGSTON, Chief Justice.
On May 4, 1956, appellant, the complain-' ant in the court below, filed an original bill of complaint in the Circuit Court of Calhoun County, in Equity, against the appellees, respondents, in the court below, to foreclose a mortgage on certain real estate described therein. We will hereafter refer to that proceedings as the foreclosure suit.
