OPINION

BUSH, Judge.

Plaintiffs, Robert M. Tucker and Lottie M. Tucker, and Defendants, Garfield Crawford and Lillian E. Crawford, have filed cross motions for summary judgment under Civil Rule 56.

The facts, pertinent to the present motions, are not in dispute. Defendants were the owners of property located at 923 Lombard Street, Wilmington, Delaware, and of the dwelling house situated thereon. An agreement was entered into between the Plaintiffs and Defendants for the sale of the property and house to the Plaintiffs, and settlement was held on June 22, 1972.
