Deborah Tune was accused of driving under the influence of alcohol (DUI) to the extent it was less safe for her to drive, OCGA § 40-6-391 (a) (1), driving with an unlawful alcohol concentration, OCGA § 40-6-391 (a) (5), and driving on the wrong side of the road, OCGA § 40-6-40. After denying Tune’s motion to suppress, the trial court conducted a bench trial at which it found Tune guilty of the DUI charges based on stipulated evidence; she pled guilty to driving on the wrong side of the road.
