This was a suit of foreign attachment brought by the executors of Thomas Maslin against James IIiett and Eugene Alexander, late partners doing business under the name of IIiett & Alexander. The summons and return thereon are notin the record, and it is impossible, therefore, to ascertain whether the co-partner, Eugene Alexander, *17was served ; nor is there anything in the record to indicate an appearance on his part or an abatement of the suit as to him.
