I. INTRODUCTION
On June 16, 2010, 744 F.Supp.2d 987, 2010 WL 2428651, this Court issued an Opinion and Order (Doc. 26) Granting Defendant’s Motion to Dismiss for lack of subject matter jurisdiction. Plaintiff Dakota, Minnesota & Eastern Railroad Corporation (“DM & E”) subsequently filed a Notice of Appeal before the United States Court of Appeals for the Eighth Circuit (Doc. 31) on July 1, 2010.
