The special administratrix of the estate of Kenneth Marshall, her son, brought a law action for malpractice against the defendant doctor for negligently performing an abdominal operation on Marshall, resulting in his death. The petition, in so far as it need be considered, alleged in substance that the special administratrix had been awarded compensation under the Nebraska workmen’s compensation law, paid by the defendant, Employers Liability Assurance Corporation, Ltd.
