HAMLIN, Circuit Judge.

This is an appeal from an order- of the United States District Court for the Southern District of California denying appellant’s motion to set aside a default judgment. Jurisdiction of this court is based on 28 U.S.C. § 1291 (1958).

On June 22, 1962, appellant, a resident of Arkansas who was temporarily in Los Angeles on business, was personally served with process in Los Angeles in a suit before the Superior Court of the State of California in and for the County of Los Angeles brought by appellee as an assignee on a promissory note. 1 At 9:30 a. m. on July 3, the…
