HAWKINS, Judge.
— Conviction is for murder. Punishment ten years in penitentiary.
On December 2, 1919, appellant killed John Richards by shooting him with an automatic pistol. The killing occurred at the home of Edward Hammer, a brother-in-law of appellant. Appellant, his wife and the deceased were all practically raised in the-same neighborhood. Some fifteen years before the homicide deceased and Alice Hammer had been sweethearts and engaged to be married.
