HAWKINS, Judge.

Appellant was convicted of murder growing out of the killing of one Jim Richardson, and his punishment assessed at fifteen years confinement in the penitentiaray.

Richardson was killed on the 9th of March, 1920, by appellant who shot him with a gun in the night-time through a window at the home of deceased while the latter was sitting on a trunk writing a letter to a seventeen-year-old girl, the sister of appellant’s wife.
