KRUEGER, Judge.
The offense is murder. The punishment assessed is confinement in the penitentiary for life.
From the record before us, it appears that about 5:00 P. M. on August 29, 1939, the appellant shot and killed J. I. Thomas on the landing of the stairway leading to the Uptown Club and the 21 Club room on the same floor, located on Capital Avenue, in the block between Milam and Travis Streets in the City of Houston, Harris County, Texas.
